In other words, employees are offered voluntary leaves of absence based on their goodwill and a company’s unique internal policies. Even if an employee has used up all of their paid time off, you may choose to accommodate their absence in exceptional circumstances.

In addition to granting employees the right to take time off, the FMLA requires employers to maintain employees’ health benefits during the leave and to reinstate them to the same job position upon returning. As an employer, you have the right to request official proof of your employee’s need for a leave of absence. Let’s take a look at a step-by-step FMLA process for employers:

  • First and foremost, you should determine if you’re required under the law to provide FMLA as an employer, which is dependent on the number of workers you employ. If your company has fewer than 50 employees, you are not required by law to provide an FMLA leave of absence.
  • Your employees are eligible for FMLA leaves of absence after working a minimum of 1,250 hours within your firm.
  • FMLA only covers leaves of absence due to grave family and medical issues.

  • When needed, ask for more information and medical certifications; you may use your right to decline requests unless due certificates are provided.
  • Ensure that all employees are well-informed about your policies;
  • Process requests and takes decisions in up to 5 business days.
